The Environmental Impact Assessment as a ‘Requirement Under General International Law’ and Its Potential Correlations

In this study the author will examine the new principle of the general international law declared by the International Court of Justice. The Board added the requirement of undertaking an environmental impact assessment as a general principle in the Pulp Mills on the River Uruguay case, but they were reticent about the exact content. On the one hand, we will traverse the judgment itself with the potential correlations of the principle, especially the transboundary context and the other environmentally relevant judgments. On the other hand, we consider the link between the requirement of undertaking an environmental impact assessment and the precautionary principle, as well as the connection with the sustainable development.
